Daubert is not a medicine problem. Under Kumho Tire and the 2023 amendment to Federal Rule of Evidence 702, the trial court's gatekeeping applies to every form of specialized testimony — DNA & forensic biology included. You can't rule out contamination during collection, can you?

Why it works: Contamination / controls. Point to the controls and chain of custody.

A stronger answer: “I relied on the documented chain of custody and the negative controls and noted any gap; I did not assume away contamination.”

Assumptions: the one premise that sinks the opinion

The cross-examiner's question sounds simple:

Your random-match probability assumes the relevant population database applies — correct?

Why it works: The database-population assumption. Disclose the database and its fit.

A stronger answer: “I used the appropriate population database for the relevant population and disclosed which database and why.”
