Methodology

Baseline. Each state's headline medical-malpractice SOL is coded from the governing statute as of 2024-2025. These are anchors; the individual tort case type may shorten or extend.

Discovery rule. Where the state recognizes a discovery rule for med-mal, the calculator uses the later of (incident + baseline) or (discovery + baseline). States without a recognized discovery rule use the incident date only.

Minor tolling. The calculator applies the state's specific rule (e.g., until age 8, age 18, or incident+N years). Medical malpractice often has a carve-out; we flag states where the general minor-tolling rule differs from the med-mal rule.

Government entity. Most states require a notice of claim within 90-180 days of the incident, separate from the SOL. The tool surfaces this if applicable.

Statutes of repose. Many states have a hard cap (4-10 years) that applies regardless of discovery. The tool applies the repose cap when triggered.
