Medical Malpractice Damages Calculator

Free tool. Economic + non-economic + present value. State-specific non-economic caps applied automatically.

Compute total damages in 30 seconds. The calculator applies present-value discounting to future losses and checks your jurisdiction's non-economic cap (California's MICRA, Texas's $250K, etc.). Informational only — verify cap figures against current statute.

Methodology

Present value. Future losses discounted to present value using a uniform-annuity approximation: PV = total × (1 − (1+r)^−n) / (r × n). This treats the future stream as a level annuity over n years. Real cases should discount year-by-year with jurisdiction-specific real discount rates.

Non-economic damages. Calculated as (pain-multiplier × past medical) plus the ratio applied to PV of future medical. Standard 1x-5x range; catastrophic cases often 3-5x. Your mileage varies by facts and venue.

Caps. State cap data verified against governing statute as of 2024-2025. California's MICRA cap is rising annually; check current year. Some states have separate wrongful-death caps — tool flags where known.
